Under this rule, the law does not apply if the relationship of employment is governed by an agreement with a given employment term. Additionally, the employment at will doctrine shall not apply is the agreement and contract offers that a worker cannot be dismissed unless the employer has a good cause. There are a number of different types of diabetes, you have; Type 2, Type 1, Gestational diabetes, Pre-diabetes, lada, mody, Diabetes Insipidus, out of all these types there are some types of diabetes more prevalent than others, the most common type is Type Two, and this type can causes damage to both large and small arteries. This artery damage can result in medical problems, both common and serious; Heart attack, stroke, amputations, kidney failure, and blindness. Type Two can also cause damage to your nerves, you have a percentage of 60% to 70% of diabetics that develop diabetic nerve damage, with that you can result in the following health problems; Peripheral neuropathy, stomach and bowel problems, dizziness when standing, sexual-function problems, and localized nerve failures. With all of these health problems and potential complications you can significantly shorten the life of a person with type 2 diabetes. They all have the ability to diminish the quality of life. You can avoid these problems and even prevent them through diet and exercise, use of medication, and careful control of your blood sugar levels. With diabetes the best way of avoiding the risk of developing it is to avoid it altogether, you can make sure you talk with your doctor about your risk of getting diabetes and how to avoid it, start screening for early detection, these screening test will help to find diabetes when it is most likely to be treatable. With the screening test it will uncover the pre-diabetic state before your blood sugar rises. If you are considered over weight you should talk with your doctor about doing a screening test so that you catch it on time and are able to take care of it before it may cause any major problems. You can change your life style by getting more exercise and keeping more hysically fit, change your diet by replacing any unhealthy foods with more organic and nutritional foods, with the right amount of proper food and exercise you can take your own personal stand against diabetes, if you take the necessary steps to lose the weight you will lower your chances of developing diabetes, and extend your life expectancy, and you will not have to worry about developing any other health problems that diabetes may cause, diabetes is like a domino effect, once you have diabetes you can develop other health problems and all of them will have a negative effect on your life, making sure you lead a positive, an d healthy life style will lower your chances of developing diabetes or any other chronic disease that may reduce your longevity of life.

Anchor systems are vital for a climber and whether or not an anchor is secure can mean the difference between life or death for the climber. Good anchors are not difficult to set up and all they require is a little experience in setting up and some common sense. We will anaylze the forces generated in two different types of anchor systems. Another factor in the forces generated in an anchor system that can be applied to both systems is that of the angles involved in the system. The greater the angle at the bottom of the anchor system, where the rope attaches to the anchor, the greater the force that is exerted on each anchor point. The table below reflects this. The American Tringle is an anchor made in the shape of a triangle. The force on either anchor point is equal to where F is the force exerted on the lowest carabiner in the system. With an angle of 60 degrees this force is equal to the force exerted on the system. Any smaller angle will mean a greater force on the anchor points. This anchor will effectively double the forces present in the anchor system compaired to the Equalized V anchor, making it quite a bit more dangerous. The Equalized V is an anchor in the shape of a V. The force it exerts on each anchor point is , where F is the force exerted on the system. At 60 degrees it exerts a force of F/2 on each anchor, so it is much better than the American Triangle. This is a fall. If you climb it will happen to you. Sometimes in hurts. The rest of the time it really hurts. This is especially applicable in lead climbing where you place protection or clip into bolts as you climb. In lead climbing you can easily take falls of more than 10 meters. 'Static' climbing ropes are not really static, but actually just low elongation. Suppose, climbing with static rope, a 60 kg climber was to fall from thirty meters, with his last piece of protection 5 meters below you. He would then fall 10 meters. Assuming that his rope stopped him in 1/10 of a second, the stopping force he would feel would be equal to 8.4 kN, and the force on the anchor would be twice that, 16.8 kN. While most carabiners are rated up to 20+ kN, most ropes can withstand significantly less, usually about 9 kN.

INTRODUCTION English language is the main international English. It is also said that English is the language of progress and development. In this age of internet and globalization, the use of English has increase tremendously. Most of the non-speaking English countries take great importance in English education. China and Malaysia being one of them. Ministry of Education (MOE) in Malaysia has been trying for years to improve the standard of English language especially in communication and writing by implementing efforts such as research on methods that could be applicable in Malaysian schools.English language has been accorded for second language in Malaysia as stated on Article 152 and been given due attention for years. Teaching English can be declared as challenge in Malaysia because the subject has always been argued, doubted, changed for many times that the issues has never been completely resolved. Meanwhile, MOE keep trying to improvise the teaching and learning process in sc hools from early education to the highest level by employing suitable means and aids such as bringing in modern teaching methods from Western countries.Communicative teaching methods and grammar-translation has been discussed, implemented on English language teaching in China based on the article by Jin, Singh, and Li (2005). This paper will provide the critical review of it, and the relevance of the methods in Malaysian Schools. 2. 0 COMPARISON BETWEEN COMMUNICATIVE LANGUAGE TEACHING AND GRAMMAR-TRANSLATION Based on the article by Jin, Singh and Li (2005) the CLT and Grammar-Translation method might not be applicable to all teaching situation.While the final result of the study was in favour of CLT methods, the gaps between the results on test paper for two groups are low. Futhermore, the research done by Rao (2002) concluded that students claim that using Grammar-translation method will be more suitable for class session in China. Since teaching is deeply rooted in the local philo sophy, culture, and basic concepts of education, the students’ learning styles and habits in language acquisition must be considered. Although the grammar-translation method is out of favor, students accustomed to this method may still derive benefit from it. Therefore, in teaching English to Chinese students, appropriate grammar analysis is essential, especially for beginners. Limited utilization of translation from or to the target language is an indispensable part of teaching. Vocabulary work and pattern drills are also ways of familiarizing the student with sentence structures.This information helps learners acquire linguistic competence. The main features of GT are: 1. It is teacher centred and does not cater for the learner’s individual needs 2. The emphasis is on grammar learning through verb drills, the translation of written texts and the memorization of wordlists 3. The focus is on the product rather than the process of learning; 4. Language is viewed as a body of knowledge rather than an instrument for communicating and functioning effectively in the real world 5.Linguistic practice is confined to the memorization of words and rules 6. Instruction aims at the mastery of the written medium rather than oral communication 7. Accuracy rules over fluency 8. Correction is all-out and punitive 9. The L2-model adopted is elitist and so is the educational philosophy 10. Feedback on learner performance is not likely to be helpful as it is solely accuracy-based But instead of teaching grammar traditionally and drilling grammar patterns, teachers need to relate teaching grammar and pattern drills to meaning and use.In other words, language structure practice should be used in contexts that involve some basic principles of appropriateness. This is the exact area that the traditional ESL teaching has long overlooked—teaching English for a communicative purpose. Thus, English teaching should be partly communicatively oriented, so students can acquaint themselves with appropriate language usage. the main pedagogical principles advocated by CLT are: 1. It is pupil-centred rather than teacher-centred 2 The emphasis is on communication and effective interactional skills 3.The focus is on the process rather than the product of learning; 4. Language is viewed as a skill to learn rather than a body of language  to pass on to the pupil 5. Linguistic practice occurs through communicative activities 6. Instruction aims at the mastery of all of the four core language skills 7. Fluency rules over accuracy 8. Correction is selective and non-judgmental 9. The L2-model adopted is flexible and can deviate from the L2-standard Form 3. 0 RELEVANCE TO MALAYSIAN SCHOOLS. In Malaysia, the teaching of English language starts early, as early as in kindergarten between the ages of 4 to 5.Students were exposed to many kinds of teaching methods from the traditional approach such as gra mmar-translation and towards more modern one like CLT. It is common for teachers to support the one that is more effective and theoretically sound basis for teaching. After independence, the changes was made for education in Malaysia where instead of using English language in school, the medium of teaching and learning process changes to Malay. Thus, affecting the teaching methods in Malaysia where teachers will provide materials and lecturers to students and teacher-centred classroom were practiced.Malaysia introduced the communicative syllabus in 1970. Back then, the study of grammar was considered not ‘fashionable’ and out of date. Students were not taught how to build correct sentences in English. Too much emphasis was placed on spoken English. Role-play and how to respond to given situations took centre stage. CLT method is one of the famous methods used by teachers and claimed to be more effective rather than GT. Krashen and other SLA theorist stress that language learning comes about through learning language communication rather than through practicing.Johnson (1984) and Littlewood (1984) consider that the acquisition of communication competence in a language is an example of skill development. On the other hand, the draw backs from this method are the need of an authentic materials and interaction between learners with them using only the target language as means of communication. Comparing to schools in urban area, most of the schools in rural area lacks the means of these authentic materials and ready interaction from outside. Malaysian people used Malay, Chinese, and Indian to communicate especially in rural area where English has not been used at all.This in turn will affect the communication grasp of students in rural schools where the proficiency in English are low. Thus, in turn, students will refuse to join in the interaction by being silent and it will hinder the teaching and learning process as they cannot catch up to the class lesson. The students in rural school still depend on teacher translation as their lack of exposition to English language will lower their proficiency. They could not speak the language fluently and need to learn the language structures and understand it from basic and practice by their own.It is different for students enrol in urban area where they were pre-disposed to the languages already. Most of them start to learn English from child where their cultural environment and socio-economy were contrasting from students from rural schools. They might have help with their parents and family and the more modern school system in the city. Technologies were blooming in this area where the students’ proficiency is slightly higher. Because they might be aware of the language and have practice them, communicative approach can be adapted to their teaching and learning process.But even so, teachers claimed that practising CLT method in class will take too much time and works as it requi re complete involvement from all students because of its learner-centred style. Because of this, the lack of practice will somehow affect the learning of the grammar structure and glaring mistakes from students for writing will form as CLT method is divulging more into developing students’ communicative approach. Yes, their speaking skill will be better as will their listening skill but that will not promise them 100% correctness in spelling and grammatical uses.The solutions to this are that both students should try to adapt both methods in learning a second language in Malaysia. The students need to be taught on how to learn not only of the language but to practice the language as frequently as possible. The CLT method can help the students develop an insight into the language and prepare them into an environment where the language are the only one use to communicate. On the other hand, grammar-translation will help the students practice the language on their own where ther e is no exposition of the language around them.Teachers can provide materials for these students to facilitate or encourage them to learn it independently without being too dependent on teacher. CONCLUSION Various efforts, on both national and individual levels, have been poured into the strategies to improve students’ ability or command of English language. There are of course many methods in second language teaching which include the Grammar Translation Approach. This approach was historically used in teaching Greek and Latin and later modern languages.Experienced teachers said that if they did not engage the help of the mother tongue, the lesson would involve a lot more time and resulting in students that were indifferent and psychologically were not there. ESL teaching in Malaysia, with its traditional setting, is markedly different from that in the United States and Great Britain in that it is conducted in different social and cultural contexts. Yet this does not mean th at the communicative approach is not applicable in such a context. By practicing CLT alone, it might be hard for teachers to attract students to participate and thus wasting time in trying to facilitate them.So, as to make this approach work well in here, we must reconcile it with the traditional grammar-translation method that is still popularly used in Malaysia. Anthem Essay No â€Å"I† and no â€Å"you†, just â€Å"we. † How could we live in a world like that? Ayn Rand’s book shows a twisted and different form of collectivism. Everyone is told what they have to do for the rest of their future. Children are not even allowed to know who their parents are and are never given the chance to meet them. Although, only one shines in the society that no one else may see until now. Equality finds it difficult to find individualism in his life and in the rules of his society. Equality eventually finds individualism in escaping, to a haven of his own, from his odd society. Equality can then find peace with himself and can live in a more individualistic life in his newfound house with â€Å"The Golden One† in the forbidden and Uncharted Forest. This forest had been banned because no one had â€Å"known† what was beyond the tree line. Equality had experienced many emotions but the three major ones experienced by Equality are individualism, self-confidence, and trust; these quotes need to be explained. To begin, the first quote states, â€Å"To be free, a man must be free of his brothers† (Rand 101). In this chapter, Equality describes how he feels about his past society. He also now gives himself a new name, Prometheus, after the god who had taken light from the heavens and had brought it to man. He then named, â€Å"The Golden One†, Gaea who was the mother of Earth and of all gods. Equality then explains to us how we must not be tied down by our friends or peers. We should be allowed to make our own choices, even though some peers may not accept this decision, we should be allowed to live independently. Freedom should only be taken away by one’s self, or if someone has committed something so sinister that he or she’s rights and freedoms should to be taken away. Anyone’s freedom should be preserved as should everyone else’s freedom. Equality feels he is the only one with his head on straight now and that he is the only one that can slowly turn this confusing world around. The next quote states, â€Å"It is the mind which thinks, and the judgment of my mind is the only searchlight that can find truth† (Rand 94). This quote is from chapter eleven in which during this chapter Equality describes how he is done with the word â€Å"we† as it is destructive to society, to a certain point. At this point of the story, Equality is describing the aspects of his mind and how it will help him find his new world and where to start his own society over, in a sense. He believes only his mind can find truth because his old friends are still absorbed in the collectivist society that Equality can’t stand anymore. He wants to become a one of a kind in history and to create a name for himself that everyone will remember. He will not only follow in his old societies footprints but will instead follow his anestrous ways of society. Equality also feels that it is necessary to find truth in his life about past life before the collectivism era and society had started. The ancestral ways that had individuality and creativity. The world was colorful with life then. Equality’s life is now so dull and boring. Equality wants to start his own society where he believes that everyone is to be treated equally, hence his name. He doesn’t believe that people should be chosen for what they do for a living and rather let them choose what they would like as a living. Equality realizes he can turn this world around but he needs to trust himself to do that because it will take time. The last quote, from chapter twelve, states, â€Å"And we thought we could trust this being who looked upon us from the stream, and that we had nothing to fear with this being† (Rand 80). Equality is explaining how all humans thought they could trust themselves running that collectivism society that he had so gratefully left. He realizes he had everything to fear from the twisted society that he lived in. Equality had trusted himself enough to completely let go of his old society, to leave everything behind and adopt a new culture. He must have trusted himself immensely to have done this. He also realizes humans are much too smart to govern that society and wonders if they were just too afraid to contradict their government or just did not trust themselves to try and overthrow it. Equality realizes he should be confident in himself. He is a very headstrong person and is not persuaded so easily. That is why he had left his society in the first place. Equality would like to live as an individual where he would not work together for the common good, as a group, but where he alone will work as an individual in his new society that he will soon create. Ayn Rand’s novel puts Equality in a great position to start his new life with his new family. Ayn Rand’s story gives hope to all who want not to be conquered by their government and to have a say in what they believe in. If your government or society doesn’t like what you have to say, then it shows you can also walk right out the door if you don’t like what is happening. When you become a collectivist, you lose your individuality and almost become a slave and or a robot to the government and society. You lose your creativity and lose your ability to function as a citizen. The novel shows individuality in people and that all people don’t think alike even though they may be told to, you cannot stop a person from thinking what they want to. In conclusion, three quotes discussing individualism, self-confidence, and trust were described more widely and in depth.

The flagship campus in Madison requires two essays. Applicants can apply using either the Common Application or the University of Wisconsin Application. This article addresses strategies for responding to the essay prompts.   Personal Statements for the University of Wisconsin-Madison The main campus of the University of Wisconsin in Madison is the most selective of all the UW schools, and it has an application separate from all the other campuses. It also asks for two personal statements. If you apply using the Common Application, you will need to respond to one of the seven essay prompts. This gives you the freedom to write about anything you choose, for not only do the prompts cover a wide range of topics, but option #7 allows you to write on a topic of your choice.   If you use the University of Wisconsin application,  the first essay prompt asks the following: Consider something in your life you think goes unnoticed and write about why its important to you. You have so many options here that you might find the essay prompt daunting. As you figure out what the something in your life is that you should write about, keep in mind the reason why UW-Madison is asking this question. The admissions process is holistic, so the university wants to get to know you as a whole person, not just as a set of empirical data such as grades, class rank, and standardized test scores. Your extracurricular activities and employment history are part of the holistic portrait, but they dont tell the whole story.   Use this prompt to explore something that isnt obvious from the rest of your application. If one of your jobs or extracurricular activities is particularly important to you, you could use this essay to explain why that is so (much like a typical  short answer essay  on the Common Application). Resources for Teaching Tolerance and Anti-Racism    People are not born racist. As former U.S. President Barack Obama, quoting Nelson Mandela, former president of South Africa, tweeted shortly after the tragic events in Charlottesville August 12, 2017 in which the university town was overtaken by white supremacists and hate groups, resulting in the killing  of a counter protester, Heather Heyer,  Ã¢â‚¬Å"No one is born hating another person because of the color of his skin or his background or his religion. People must learn to hate, and if they can learn to hate, they can be taught to love, for love comes more naturally to the human heart than its opposite.† Very young children do not naturally choose friends based on the color of their skin. In a  video created by the BBC children’s network CBeebies, Everyones Welcome,  pairs of children explain the differences between themselves without referring to the color of their skin or ethnicity, even though those differences exist. As Nick Arnold writes in What Adults Can Learn About Discrimination From Kids, according to Sally Palmer, Ph.D., lecturer in the Department of Human Psychology and Human Development at University College London, it is not that they dont notice the color of their skin, it is that the color of their skin is not what is important to them. Racism is Learned Racism is learned behavior. A 2012 study by Harvard University researchers showed that children as young as three years of age  can adopt racist behavior when exposed to it, even though they may not understand â€Å"why.†Ã‚  According to renowned social psychologist Mazarin Banaji, Ph.D., children are quick to pick up on racist and prejudicial cues from adults and their environment. When  white children were shown faces of different skin colors with ambiguous facial expressions, they showed a pro-white bias. This was determined by the fact that they ascribed a happy face to a perceived white skin color and an angry face to a face that they perceived to be black or brown. In the study, black children who were tested showed no color-bias. Banaji maintains that racial bias can be unlearned, though, when children are in situations where they are exposed to diversity and they witness and are part of positive interactions between different groups of people acting as equals.   Racism is learned by the example of one’s parents, caregivers, and other influential adults, through personal experience, and through the systems of our society that promulgate it, both explicitly  and implicitly. These implicit biases permeate not only our individual decisions but also our societal structure. The New York Times has created a series of informative videos explaining implicit biases.   There are Different Types of Racism According to social science, there are seven main forms of racism: representational, ideological, discursive, interactional, institutional, structural, and systemic. Racism can be defined in other ways as well - reverse racism, subtle racism, internalized racism, colorism. In 1968, the day after Martin Luther King was shot, the anti-racism expert and former third-grade teacher,  Jane Elliott, devised a now-famous but then-controversial experiment for her all-white third-grade class in Iowa to teach the children about racism, in which she separated them by eye color into blue and brown, and showed extreme favoritism toward the group with blue eyes. She has conducted this experiment repeatedly for different groups since then, including the audience for an Oprah Winfrey show in 1992, known as  The Anti-Racism Experiment That Transformed an Oprah Show. People in the audience were separated by eye color; those with blue eyes were discriminated against while those with brown eyes were treated favorably.  The reactions of the audience were illuminating,  showing  how quickly some people came to identify with their eye color group  and behave prejudicially,  and what it felt like to be the ones who were being treated unfairly.   Microaggressions are another expression of racism. As explained in Racial Microagressions in Everyday Life, Racial microaggressions are brief and commonplace daily verbal, behavioral, or environmental indignities, whether intentional or unintentional, that communicate hostile, derogatory, or negative racial slights and insults toward people of color. An example of microaggression falls under assumption of criminal status and includes someone crossing to the other side of the street to avoid a person of color. This list of microagressions serves as a tool to  recognize them and the messages they send.   Unlearning Racism Racism in the extreme is manifested by groups such as the KKK and other white supremacist groups. Christoper Picciolini is the founder of the group Life After Hate.  Picciolini is a former member of a hate group, as are all the members of Life After Hate. On Face the Nation  in  Aug. 2017, Picciolini said that the people who are radicalized and join hate groups are not motivated by ideology but rather a search for identity, community, and purpose. He stated that if theres a brokenness underneath that person they tend to search for those in really negative pathways. As this group proves, even extreme racism can be unlearned, and the mission of this organization is to help counter violent extremism and to help those participating in hate groups  find pathways out of them. Congressman  John Lewis,  a prominent Civil Rights leader, said, The scars and stains of racism are still deeply embedded in the American society. But as experience shows us, and leaders  remind us, what people learn, they can also unlearn, including racism. While racial progress is real, so is racism. The need for anti-racist education is also real.   Following are some anti-racism resources that may be of interest to educators, parents, caregivers, church groups, and  individuals for use in schools, churches, businesses, organizations, and for  self-assessment and awareness. Anti-Racism Curricula, Organizations,  and Projects The Race Card Project  :  The Race Card Project was created in 2010 by NPR Journalist Michele Norris to foster a conversation about race. In order to promote an exchange of ideas and perceptions from people of different backgrounds, races, and ethnicities  Norris asks people to distill their thoughts, experiences, and observations  about race into one sentence that only has six words and submit them to the Race Card wall. In 2014, The Race Card Project was awarded a prestigious George Foster  Peabody Award for excellence in electronic communications for turning a pejorative phrase into a productive and far-reaching dialogue on a difficult topic.RACE: Are We so Different?:  This website is a project of the American Anthropological Association and is funded by the Ford Foundation and the National Science Foundation. It looks at race through three different lenses: history, human variation, and lived experience. It offers activities for students and resources for families, t eachers, and researchers. It is based on a traveling exhibit by the same name. Educating for Equity:   Educating for Equity is  the website and consulting business of Ali Michael, Ph.D., who is the co-founder and director of The Race Institute for K-12 Educators  and the author of several books having to do with race, including  Raising Race Questions: Whiteness, Inquiry, and Education (Teachers College Press, 2015), which won the 2017 Society of Professors of Education Outstanding Book Award. The Powers of the Core Executive My chosen question shall see me discuss how the reform of the British State affected the power of the core executive. I shall be focusing on key themes such as looking into the concept of the core executive and how its seen to have traditionally operated, including the Westminster model. I shall discuss debates into the relationships and powers within the core executive, focusing directly on Thatcher v Blair. I will go onto discussing the reforms within the British State, explaining what they are and how they operate, and how they affect the core executive. What is the core executive? The core executive is at the very centre of British government. It covers the very complex web of institutions, networks and practices surrounding the Prime Minister, cabinet, cabinet minister as well as committees and the less formalised groups. There is an on-going debate over relationships and powers within the core executive. Along with this are the different styles of government which every leader adopts to their own personal style. The main figure head is the Prime Minister, in which all policies have to be passed and accepted before they take their place within society. The Prime Minister also represents the country during international debates and relations. The Cabinet is another prominent figure within the core executive it tends to consist of around 20-23 ministers, each is appointed by the Prime Minister themselves. The Cabinet helps with government business such as public expenditure and constitutional issues. The Cabinet is strongly supported by the Civil Service. McEwan.N (2004). The Prime Minister V Cabinet debate has gone on for many years and shall continue to be seen as a battle between two important figure bodies. Relating strongly to the circumstances and the resources that are available at the time, may determine who may take the leading role. Prime Ministers are dependent on the support of the cabinet and without the appropriate team work wouldnt be a successful unit. Blair V Margaret Thatcher. Its believed that the resignation of Margaret Thatcher was forced upon her as she failed to recognise her dependency on colleagues within the core executive. This was due to her ignoring pleas and views from colleagues during a recession and unpopularity in the polls. During 1980 and 1990 Thatcher was seen to be a strong figure but this started to deteriorate rapidly causing more resignations under her such as John Major. THE CORE EXEC IN BRITAIN PG 102. Tony Blair did follow some traits left behind by Margaret Thatcher, but he also introduced significant changes to the way in which the government was run. Blair and Thatcher between them are the two longest serving prime ministers in the last hundred years. Thatcher when in government instituted reforms within British government, as well as opening up economic and global competition. BRITISH POLITICS PG 302. *****Reforms in the British state, what are they? What has been their effect? How have they affected the core executive There have been many reforms within the British state over the years, with each prime minister bringing in reforms that they believe are needed at that time. Margaret Thatcher had big involvement in the reform of the central government when she was in power. Thatcher wanted to reduce the size of the state by reducing the amount of civil servants. This was mainly due to privatisation; thatcher believed that by reforming the central government it would become more efficient and better value for money. CORE EXEC PG 200. With many new reforms being introduced this brings implications to the core executive such as resources and relationships, and how they are utilised. Thatcher wanted to increase the power of authority and was committed to ensure that the reforms she brought in wouldnt be easy to reverse. CORE EXEC PG 212. Tony Blair was known to be trying to adjust the way in which the core executive was set up, after Margaret Thatcher. With the British state being a parliamentary one the core executive works within a parliamentary framework. The core executive has lost power, due to the reform and the movement of powers within the core executive. It is believed by Rhodes that the differentiated polity has had a great impact on the core executive making it more about co-ordination rather than direction of power. PAGE242. Aaron Beam and the Health South Fraud Essay

In reference to the Aaron Beam and the HealthSouth Fraud case in our text Velasquez (2012), the following questions from the text and my answers to these questions are provided as requested. 1. Which of the â€Å"obstacles to moral behavior do you see at work in Aaron Beam’s behavior and thinking? In Scrushy’s? The obstacles I see in Aaron Beam’s behavior are â€Å"Rationalizing Our Actions and Displacement of Responsibility†. Rationalizing his actions is supported by comments he made in reference to the actions he had or was about to take in supporting his employer. Aaron Beam stated in Velasquez (2012), â€Å"He described the move to himself as aggressive accounting but definitely not fraudulent† (p 68). In the continual cooking of the books, each time Beam was press or directed by Scrushy to do so. Aaron Beam possibly considers that to be his get out of jail free card, by pointing the finger back at his employer, as displacement of his responsib ility. We see clearly what he was thinking in Velasquez (2012), as he â€Å"felt it was technically within the bounds of accounting rules and investors would be sophisticated enough to understand what was happening† (page 68). This would relate to â€Å"Biased Theories about Others†, as he believed this group of investors was sophisticated. You cannot help but think he also felt secretly an investor(s) would question their actions and bring them to account for their actions considering the situation he was in with his employer. The obstacles I see in Richard Scrushy’s behavior are â€Å"Disregarding or Distorting Harm, Euphemistic Labeling, and Rationalizing Our Actions†. In reference to â€Å"Disregarding or Distorting Harm† based on the belief he was doing a good thing by providing rehabilitation therapy to patients at lower costs than regular hospitals, one could surmise he found doing whatever it takes to succeed he would do, all on the backs of his em ployees, of which as CEO he could discredit at will. We could also, along these lines consider â€Å"Euphemistic Labeling† as he was not above lying as interpreted by the various financial reports produced to make the company look more profitable under the veil of only business. He himself would feel pressure in 1996 as they could not meet second quarter projections. He would once again ask Aaron Beam to cook the books, or the company would face financial ruin. Scrushy rationalizes this away by saying in Velasquez, (2012), â€Å"If they could just get through the quarter, then everything would be okay† (p 69). We see clearly what he was thinking as up until now he felt everything was going his way; just one more time let the dice roll. This would relate to â€Å"Biased Theories about Oneself†, as he is very confident in his abilities, so what random event could he not control, after all he was the third highest paid CEO in the America; he had to be doing it right. 2. Explain how Aaron Beam might have used the â€Å"loyal agent’s argument† to defend his actions. Do you think that Aaron Beam’s situation the â€Å"loyal agent’s argument† might have been valid? Explain. Under the â€Å"loyal agent’s argume nt† Aaron Beam’s defense would be that Scrushy had ordered him to manipulate the accounting records or more specifically the general ledgers. He was seen as reluctant to comply, but was pressured by Scrushy and a bit intimidated by him to the point at times of fear. I do not believe Aaron Beam could have actually used the â€Å"loyal agent’s argument†. The information shows Scrushy and Beam knew as stated in Velasquez (2012), â€Å"From the beginning Scrushy and Beam both knew the company had to appear profitable to satisfy investors and lenders and to later succeed in issuing and selling company stock to the public† (page 68). Therefore, Beam had to know Scrushy would be asking or ordering him to make it happen. Based on Beam’s reluctances, it could be argued he knew this to be wrong but did it anyway. 3. In terms of Kohlberg’s views on moral development, at what stage of moral development would you place Aaron Beam? Explain. At what stage would you place Richard Scrushy? In terms of Kohlberg’s views I believe Aaron Beam’s moral development would be a Level Two Stage Three. My rational for this is he knows right and wrong both conventionally and what the law says. He exhibits this by his initial reluctance to support Scruchy’s decision to manipulate the general ledgers. He also is in awe of Scruchy, and appears to want to please him as a person in authority, and shows his loyalty to after all Scruchy picked Beam to start the company with. In terms of Kohlberg’s views I believe Richard Scruchy’s moral development would be a Level One Stage Two. My rational for this is it is all about him; he is self-centered and looks at things only from his own point of view. To support this we only have to look at his life style, he has been married three times, lives extravagantly, while charitable it appears he threw money around for self-recognition. The pleasures he gains by all of this gives him reason to assume he is right in his own mind. To support this further his own employees describe him as a dictator, cult-like figure, and a great motivator. B2B and B2C: Their ethical, legal, and regulatory environments Essay

The marketplace of internet commerce is rapidly expanding. Although there are wide variations within each category, internet-related businesses are usually classified as being either B2B (business-to-business), or B2C (business-to-consumer) enterprises. The economic landscape in which these companies operate is always changing. For that reason, it is all the more necessary for there to be a firm concept of the ethical, legal and regulatory responsibilities within this emerging marketplace. B2Bs and B2Cs share many of these responsibilities in common. In some cases, however, there are particular nuances of operating a B2B that may call for a different framework than is necessary for operating a B2C and vice versa. The variations between these businesses are continually widening, meaning that the particulars of the ethical, legal and regulatory frameworks will differ. The overall goal of these frameworks is the same-establishing the concept of trust. Trust is the key to establishing any reputable, successful and long lasting business. Overview B2Bs (business-to-business) are business that interconnect using the internet. In other words, they are businesses that buy and sell to each other. B2Cs are businesses that use the internet to sell to the end consumer. It may be the internet site of a well-established department store, or it may be a business that uses the internet as its only point of contact with consumers. The world of internet business is still relatively new. As it continues to grow, it will have to adapt to regulatory and legal changes. The continued emergence of variations within the E-marketplace is a challenge to those concerned with ethical and regulatory issues. Far from being on the wane, these issues are more common than ever. According to market forecasters â€Å"Security and privacy issues along with e-business regulatory issues will become more prevalent† (Warholic, 2007). Ethical environment Conduct of B2B transactions is reliant on the two-way sharing of information. As a result businesses on both ends of the transaction must make sure that information platforms are secure, and accessible only to authorized personnel. Since trust is a critical element in E-business as well as more traditional forms of business, professional codes already in existence are applicable in both areas. Unfortunately, industry-wide adherence to these codes is lacking. Companies are struggling with the wide array of issues raised by internet commerce. A recent report on the publications industry highlighted one of the many potential ethical problems of conducting business in an advertising-driven media. â€Å"†¦several respondents indicated that there was too much of a blur between editorial and advertising departments† (ASBPE, 2006). Another likely area of ethical focus for the B2B industry is highlighted by Laura Spense: â€Å"What about the facilitating of fraudulent activity? (Spense, 2002). In an environment with a multitude of partners, platforms and subsidiaries how much responsibility does a B2B company bear for the actions of its partners? In Spense’s example, a B2B bank was knowingly enabling one of its partners to conduct illegal activities overseas. Again, examples similar to this could arise in any number of industries. Ethical responsibilities for B2C companies often revolve around the protection of customers’ information. Some companies have developed software limiting customer information to only a few responsible parties. Others have not been able to resist the financial lure of information sharing or selling. This division is likely to continue until it is addressed more completely by legal and regulatory efforts. In the mean time, there is an opportunity for ethical businesses to develop strong reputations that will benefit them far into the future. Legal environment Legal concerns in E-business span a wide array of areas. There are the obvious concerns such as customer security and privacy, internet fraud and identity theft that relate most often to B2C businesses. Most case law that has been developed addresses these issues. Because these crimes are the most high profile, they are the predominant focus of the legal system. As criminals adjust to these legal efforts in any number of ways it will require a sophisticated and ongoing effort to prevent their actions. There are also possible legal issues below the surface that can be just as important. For example, the difficulty of determining the legality of electronic documents can pose issues, particularly for multinational B2B companies. What appears to be a legal document may not be admissible in court as evidence. Time differences can also result in an agreed upon document bearing one date in one country but having another effective date in another country. Because B2Bs can employ many networks and partners, it can be difficult to determine legally who bears responsibility on a particular issue. These are examples of small details, in the B2B context, that can have large legal consequences if not properly attained to. Regulatory environment The internet is still relatively unregulated. That is beginning to change in a few areas, however. Most regulation is targeted toward B2C companies, coming in the form of consumer protection measures. The government is becoming more assertive in prosecuting internet fraud, gambling, child pornography and spamming violations. It is likely that additional laws in these areas will be enacted in the coming years. The issue of taxation is also currently under debate. This is of particular concern to B2Cs, which in years past have been able to lure customers by selling their product without any sales tax. That practice has already been ended in some states. As more states become cash-strapped, this process is likely to continue. B2C firms will have to innovate in order to continue the growth of their customer base. The Uniform Commercial Code (UCC) applies to both B2B and B2C enterprises. The UCC outlines warranty, ownership and expert status issues, making some delineation between the responsibilities of B2Bs and B2Cs. For example, under the UCC, a business client is assumed to have a greater level of expertise about the transaction at hand. Therefore, statements or claims made to that client do not necessarily have to meet the same standards of reliability as statements made to an end user in a B2C transaction. The main regulatory concern in regards to B2Bs involves the prevention of monopolistic practices, including price fixing. The formation of some large B2B firms such as Covisint, a firm formed by Ford, DaimlerChrysler, and General Motors, has raised concerns about the potential domination of market share. Critics fear the emergence of monospony – a shift of pricing power from buyers to sellers (IGE, 2001). Conclusion The only thing that is certain about the internet business environment is that it will continue to change and evolve. The government will likely become a bigger factor in terms of laws and regulations, particularly within the B2C market. The B2B market, in contrast, is better able to self-regulate. Ethically both markets would be best served by anticipating potential regulatory and legal action. This has a dual purpose. It helps to establish the company as a trustworthy entity. Also it can help to head off future government interference in the market. The consequences of a lack of trust are particularly high for a B2B company, but the issue is important for any company hoping to operate profitably over the long-term.

Values are instrumental in how we behave and the choices we make. Ethics are professional rules that define how different groups of people should behave. There is a distinct sense of right and wrong with little room for â€Å"grey† or questionable behavior. Ethics guide and dictate what is professional and acceptable to each given profession. To behave ethically is to behave in a manner consistent with what is right and or moral for the profession. Values and ethics are forever at a crossroads because today’s society pushes towards personal wealth. The stakes are constantly raised as far as what it takes to gain that wealth. (,2010). It is not uncommon for people to share private information, set someone up, edit what a person has said or completely alter a picture someone has taken for their gain. It is in situations like this that values are tested and ethics are ignored. Professional values and ethics are commonly derived from government laws and regulations, state licensing boards, and trade associations. A professions code of conduct will â€Å"contain provisions that are designed to advise, guide, and regulate behavior on the job. † (Madsen & Shafritz, 1990, p. 205). There are also federal, state and local laws which regulate and enforce most professional industries. According to The United States Department of Labor (n. d), Government agencies such as OSHA (Occupational Safety and Health Administration) were created to â€Å"assure safe and healthful working conditions for working men and women; by authorizing enforcement of the standards developed under the Act; by assisting and encouraging the States in their efforts to assure safe and healthful working conditions†¦Ã¢â‚¬  . Professional associations such as the Society of Professional Journalist also have their own values and ethics which are set forth to guide their members. Conscientious journalists from all media and specialties strive to serve the public with thoroughness and honesty. Professional integrity is the cornerstone of a journalist's credibility. (Society of Professional Journalist, 1996). Each association clearly outlines its expectations in hopes that all members will abide by them and act in a professional manner. One of the biggest sectors of media affected by ethical conflicts is the advertising market. â€Å"For some business ethicists, advertising is one of the most crucial issues in corporate ethics because its pervasiveness and because of its power to mold consumer thinking and behavior. For example, many have argued that advertising is a form of a behavior control, given its subtle psychological persuasion and its repetitiveness. One such argument holds that advertising creates in the mind of the consumer a need – not just want – for that which is advertised. When the consumer in question happens to be a child subjected to a barrage of TV ads about toys, sugared cereals, candy, and so on, then the ethics of advertising taken as a form of behavior control is even more crucial. † (Madsen & Shafritz, 1990). Photographers also face backlash as women’s advocacy groups rail against the use of airbrushed models in print media. â€Å"You have to accept that fashion is fantasy. It's wearable art,† says Andrew Matusik, a New York fashion photographer and the owner of Digital Retouch, which specializes in celebrity and fashion retouching. â€Å"It's all about creating drama. † (Bennett, 2008). It is widespread knowledge that any photographer with any basic graphic design skills can and will alter an image to suit his client’s needs. As technology evolves so do the ethical standards which advertisers and photographers are held to. Another form of media mired in controversy is reality based investigative news shows. One such show, Dateline’s â€Å"To Catch a Predator† purported to take child sex predators off the street as they taped a series of sting operations set up by various law enforcement agencies. The show faced a firestorm of criticism when a Dallas, Texas man committed suicide moments before he was to be arrested on charges of engaging in sexually explicit chat with a minor. The man’s family sued the network and won a substantial award. The presiding judge ruled â€Å"that the network crossed the line from responsible journalism to irresponsible and reckless intrusion into law enforcement. † (Shea, 2008). Although the show was very successful for the network, it was cancelled shortly after the lawsuit. While it is widely believed that being ethical and sticking to one’s values will lead to an honorable and decent career, the examples illustrated above show that more and more people are willing to push the envelope of professional values and ethics. Personal gain has taken a back seat to deceny and commen sense in many professions. This leaves us with an urgent and pressing question-what are professional ethics and values worth today?
